Nagpur bench grants bail to bike thief

Two cases were filed even though a set of two bikes was stolen.

Mumbai: The Nagpur bench of the Bombay high court granted an anticipatory bail to a man who was named in two separate FIRs by the police even though they both pertained to the theft of one set of two-wheelers.

Justice S B Shukre granted anticipatory bail to the accused, Imran Ahmed. “It appears that there are two separate crime numbers registered against this applicant even though the vehicles allegedly stolen are the same,” said Justice Shukre.

The court observed that previously in one of the crimes, the Sessions court at Gadchiroli has granted anticipatory bail to this applicant. “In the present crime which is also in respect to the same vehicles involving identical facts, the Sessions court has denied the bail to the applicant,” Justice Shukre said.

The judge further added, “Such contradictory orders have been thus passed by the Sessions court though the fact remains that in one of the identical crime, this applicant has been granted bail. Therefore, applicant deserves to be granted confirmed anticipatory bail.”

Ahmed had claimed that he had filed complaint of assault on him against police officers of Gadchiroli police officers and hence they allegedly implicated him in false case.
