Court summons 3 cops for ‘failing’ to register rape FIR

Mumbai: A special Protection Of Children against Sexual Offences (POCSO) court on Wednesday issued summons to three policemen including a woman constable for allegedly failing to register FIR in connection with the gang rape of a minor girl in Andheri. The policemen also alleged to have forced the victim to marry the prime accused.

These officers were attached to the Amboli police station when the alleged incident took place in 2013. The special POCSO judge Mrs M.H. More issued the summons on an application filed by the victim seeking to make these policemen accused in the case registered under various sections of Indian Penal Code (IPC), POCSO and Child Marriage Act.

The summons have been issued in the name of senior police inspector Jaywant Shinde, police inspector Vivek Shinde and woman police constable Janita Bhosle who were attached to the Amboli police station back in 2013. The court has asked these policemen to appear before it on June 10.

The court issued summons after hearing arguments of lawyers of policemen and advocate Wesley Menezes who had filed the application, on behalf of complainant the father of the victim, seeking to arraign these persons as accused in the case.

The application filed through advocate Menezes stated that the victim had given her detailed statement before the Special Investigating Team (SIT), which is conducting the probe in the matter. In her statement she has narrated the sequence of incidents that led to her sexual abuse. She explained role of all individuals, including the policemen. According to her one of the incident transpired in the premises of Amboli police station where she was forced to marry one of the accused who had sexually violated her.

Grievance of the complainant is that despite a detailed complaint and statement made under section 164 of the CrPC, the investigating officer did not deem it fit to add the names of all the individuals accused.
