College to pay fine for submitting marks late

University of Mumbai found that Nalanda College had delayed sending the marks of the practical exam.

Mumbai: The Bombay high court has asked Nalanda Law College, Borivali to pay a fine of Rs 15,000 for not submitting the practical marks of a student on time as a result of which the student was declared fail in the sixth semester exams.

The student approached the HC praying for directions to the university to declare him pass as the college had not forwarded the marks on time and it was not his fault.

A division bench of Justices Shantanu Kemkar and A M Badar was hearing a hearing a writ petition of Nirav Joshi, a final year law student of Nalanda College. Joshi complained against the vice-chancellor of University of Mumbai (MU) and the college after his VIth semester result was held back by MU as his practical marks that were to be added to the results of the semester exam were not submitted by the college.

Mr Joshi was aggrieved as he had appeared for the practical exams conducted by the college on the scheduled date in 2016 but his marks were not sent on time.

The court referred to an order passed in a similar issue pertaining to a student whose VIth semester law exam results in 2015 had been held back and directed MU to declare the result of Mr Joshi.

The HC had found that MU had held a hearing of the aggrieved student and after perusing the proof of attendance of the student, practical exam appearance and result had found that it was the college that had delayed sending the marks of the practical exam.

The court order said: “We allow this petition by directing respondent University of Mumbai to declare the result of the petitioners forthwith. Nalanda Law College is directed to pay the amount of Rs 15,000 towards the fine for belatedly forwarding the practical examination marks of the petitioner. The amount of Rs 5,000 be deposited in the concerned accounts department of University of Mumbai”.
