State tells police to file all documents with chargesheet
Mumbai: Law and judiciary department and home department of Maharashtra have jointly issued a circular, directing all the police stations to ensure that the necessary documents like panchnama, medical reports, circumstantial evidence report, seizure report and other essential documentary evidence are attached to the chargesheet before it is filed. Circular also warned that if the circular is not followed then, authorities will take stern action.
While hearing a bail petition in December last year, the Bombay high Court observed, “In most of the cases, report under Section 173 of the Code of Criminal Procedure, 1973 (a report of initial investigation to be sent by the officer to the magistrate) is not a complete.
In most cases, the post mortem, circumstantial evidence, the memorandum and panchanama are not filed as a part of the chargesheet.The court further observed, “the secretaries of Law and Judiciary Department of Maharashtra must issue circular accordingly to the police stations.”
