Domicile or not, MBBS students can pursue Post Graduate
Mumbai: The Bombay high court on Thursday ruled that students who have passed the MBBS course from the Maharashtra, whether they are domiciles of Maharashtra or not, they will be eligible to pursue post graduate course from the state quota.
The petition was filed by nine doctors, who had passed their MBBS course from Maharashtra and either have completed their internship or are likely to complete it by March 31 this year.
According to them, they all have passed MBBS course from medical colleges in the state, which are affiliated to Maharashtra University of Health Sciences and hence are entitled to get admission into Post Graduate (PG) courses in the state.
The petition challenged the legality and validity of the notice dated November 15, 2017 and published by DMER.
According to their advocate Pooja Thorat, they had also contended that the condition of domicile infringed petitioners’ right to practise any profession, or to carry on any occupation, trade or business guaranteed under Article 19 (1) (g) of the Constitution of India.
She also said that the court accepted the contention of the petitioners, that as per settled proposition of Supreme Court, there can’t be domicile criteria for PG admissions.
After hearing the arguments the division bench of Justice B. R. Gavai and Justice B. P. Colabawalla on Thursday, allowed the petition which means that students who have passed MBBS courses from Maharashtra, whether they are domiciles or not, will be eligible to pursue post graduate course from the state quota of Maharashtra.
