CBI relying on oral statements, claims defence
Mumbai: The defence lawyer of former IPS officer Raj Kumar Pandian on Saturday argued before the high court that Central Bureau of Investigation (CBI) is relying upon oral statements against Pandian to show his involvement in alleged fake encounter case of Sohrabuddin Sheikh while there are unimpeachable documentary evidence in the chargesheet which is in favour of Pandian.
The defence claimed documentary evidence in the chargesheet shows that his presence in Hyderabad was in connection with a blast case and nothing to do with Sohrabuddin’s abduction or killing.
Senior lawyer Mahesh Jethmalani claimed before the court that Pandian was the main officer who had taken on fugitive gangster Dawood Ibrahim and the ISI of Pakistan when he was with the IB. He also reiterated before Justice Revati Mohite-Dere that Pandian has been framed by the CBI in the case.
Relying on the evidence of the then additional commissioner of police of Hyderabad Vishwan-athan and a few other subordinate police officers, Jethmalani claimed that they had given details of his presence in Hyderabad in connection with a blast in Andhra Pradesh.
The prosecution case is that the accused abducted Sohrabuddin, his wife Kausar Bi and his aide Tulsiram Prajapati on the night of November 22-23, 2005 while they were travelling from Hyderabad to Sangli in a private bus.
