No relief for Kalyan woman in Pune caste violence case
Mumbai: The Bombay high court has refused to give any relief to a Kalyan woman who participated in the state-wide protest on January 3 against the violence in Pune’s Bhima-Koregaon .
The woman had argued that she cannot be prosecuted because two FIRs, pertaining to sections related to the destruction of public property registered by the Kalyan police, had been registered for the same offence which the court refused to accept.
The court said allegations made by the accused woman is not correct since the two FIRs were different from each other as the crimes allegedly took place at two separate locations and at different time.
A division bench of Justice R.M.Sawant and Justice Sarang Kotwal was hearing a criminal petition filed by Maya Kamble. .The petitioner’s lawyer argued that police had registered two FIRs on the same incident and cited the Supreme Court judgement to quash the second FIR.
After perusing two FIRs the court said that “Some of the accused are common, however, in so far as the first FIR is concerned, the accused are more in number than the accused in the second FIR and the place of occurrence of the offence alleged is also different. The incident has also taken place at a different time. Therefore we can’t accept the contention of the petitioner.”
