Binoy gets protection from arrest till July 1
Mumbai: A sessions court in Dindoshi on Thursday adjourned to July 1, the pronouncement of order on the application for anticipatory bail moved by Binoy Kodiyeri, son of Kerala state secretary of Communist Party of India (Marxist) Kodiyeri Balakrishnan. The court also directed police not to arrest him till the order pass.
Binoy had filed anticipatory bail application (ABA) before Dindoshi court in a crime register against him by Mumbai based woman alleging cheating and rape.
A Mumbai-based woman on June 13 had filed a rape complaint against Binoy, the eldest son of Kodiyeri. She alleged that Binoy raped her for years on the promise of marrying her and that she has an eight-year-old child born out of the relationship. The woman is a native of Bihar. The police have booked Binoy under IPC Sections 376 (rape) and Section 420 (cheating and dishonestly inducing delivery of property on the complaint).
According to the complaint filed by the girl, she had met Binoy for the first time in 2008 in Dubai at a dance bar, where she used to work as a dancer. "Binoy used to visit the dance bar regularly and our friendship later transformed into a love affair," the complainant had stated.
The woman learnt about Binoy's marriage through Facebook in 2018 and confronted him, following which Binoy allegedly abused her against which she filed a complaint.
Police officers of the Oshiwara police in Mumbai failed to trace him though they went to Kannur on last week and had been to his residences at Thiruvangad and Moozhikkara. Police chose to await the verdict on his bail plea before issuing 'look-out notice'.
