HC rejects AICTE order against institution

The institute claimed that the rule was for new institutions and not for those functioning prior to the rule, hence got the relief sought by them.

Mumbai: The Bombay high court has held that a rule introduced by the All India Council for Technical Education (AICTE) with regards to intake capacity of engineering colleges would not be applicable on institutions that have been functioning prior to the rule’s introduction.

The court granted ad-interim relief to a Sangli-based engineering college after it filed a plea seeking mandatory injunction against an AICTE order which sought to reduce the intake capacity of the institution for not having 10 acres of continuous piece of land which was stipulated in the rules.

The institute claimed that the rule was for new institutions and not for those functioning prior to the rule, hence got the relief sought by them.

After hearing the submissions the court said that as a civil application by AICTE in this regard had been rejected, it was granting ad interim protection to the institution with regards to reduction in the intake capacity. The court also added that as granting mandatory injunction was a process that the court was slow in passing the ad-interim would suffice.
