JJ hospital told to appoint experts to examine rape survivor

Mumbai: The Bombay high court on Monday directed the state-run JJ Hospital to appoint a medical board of expert doctors to examine a minor girl, a rape survivor, and submit a report on whether or not she could undergo medical termination of pregnancy.

The victim is on the verge of completing 27 weeks. She told the court that she belongs to a very poor family and came to know about MTP at a later stage because of improper guidance.

Victim’s lawyers Digajmaan Mishra and Vivek Tripathi had contended before the division bench of Justice R.M. Borde and Justice N.J. Jamdar that the girl’s pregnancy is the result of sexual abuse and an FIR of rape is also filed at Waliv police station in district Palghar on July 12, 2019.

The lawyer claimed that the father of the girl is a drunkard and used to beat the victim, her two sisters and mother. Following this, her mother moved with her daughters, including victim, to her sister-in-law’s house.

According to advocate Mishra the aunt allowed victim’s family to reside in their house saying they are helping in their welfare. As per an FIR in January, aunt’s son allegedly raped her in January 2019 and later on many occasion also threatened her that if she reveals this to anybody he will kill her.

According to the victim, father of the accused also allegedly sexually abused her following which she became pregnant.

The petitioner told the court that since the pregnancy is result of sexual abuse she wants to terminate the pregnancy. The court has directed JJ Hospital doctors to examine her and submit the report on August 1.
