A victim of 2008 Malegaon bomb blast case on Wednesday filed a protest petition in the special MCOCA court in Mumbai pleading that the court discard the chargesheet filed by the National Investigating Agency in which it has given clean chit to Sadhvi Pragya Singh Thakur and a few other accused.

Nisar Ahmed Sayyed Bilal (64), a businessman by profession, has filed the application through Jamiat-e-Ulema Maharashtra, objecting to NIA exonerating Sadhvi Pragya Singh Thakur, Shiv Narayan Kalsangra, Shyam Bhavarlal Sahu and Pravin Takkalki in its supplementary chargesheet.

“Perusal of the supplementary chargesheet shows that the same is filed under political influence, direction and without considering that the investigation officer has to only do the investigation and not appreciate the evidence on record or record further statement of the witnesses,” read the application.

The application has further said that initially the NIA opposed the bail plea filed by the accused, but now under the new government it is doing everything in its power “only to contradict the investigation conducted by the earlier agency and try to discredit the investigation carried out by earlier police officers, including ATS chief Hemant Karkare.”

It also referred to news about former NIA prosecutor Rohini Salian’s allegation on an NIA officer allegedly asking her to go slow in the case.

It further stated, “That perusal of supplementary chargesheet shows that the NIA officer did not try to collect any additional evidence, which can assist the court for fair trial; on the contrary they put all their efforts and concentration only on how to contradict the earlier chargesheet filed by previous police officers with sole purpose to dilute the said case against the selected accused as mentioned therein.”

“The NIA re-examined various witnesses and stated in the chargesheet they are not supporting their earlier version; first of all there was no need for NIA to re-examine the said witnesses, and if the witnesses are not supporting the case they may turn hostile before the court,” reads the petition.

The application will be heard in due course.
