Relocate stall before razing it: HC to BMC

The court directed the BMC to rehabilitate the stall owner within six weeks in the same vicinity and only then, demolish the stall.

Mumbai: The Bombay high court has restrained the BMC from evicting the owner of a stall adjacent to Byculla foot overbridge (FOB) outside Byculla station till it provides an alternate location for the stall.

The owner of the 60-year-old stall approached the court after the civic body issued him a demolition notice saying it wanted to widen the FOB to cope with the pedestrian traffic.

A division bench of justices Vasanti Naik and Riyaz Chagla was hearing the writ petition filed by the stall owner, Mohammad Sharif Qureshi, praying for quashing of the BMC’s demolition notice as his stall had been there for the past 60 years and had been rented to him by the civic body.

The BMC and the railway, which is also a party, informed the court about the urgent need for a wider bridge which could be possible only by removing the stall. However, the court directed the BMC to rehabilitate the stall owner within six weeks in the same vicinity and only then, demolish the stall.
